Terms and Conditions

I. General

Article 1. These Terms and Conditions govern the relationship between Future Seas EOOD, Unified Identification Code (UIC) 207464051, operating through the website https://futureseas.eu/, hereinafter referred to as the “Seller”, and individuals or legal entities making purchases through the website, hereinafter referred to as “Customers”.

Article 2. The website futureseas.eu offers clothing, accessories, and other products for online purchase, with international shipping available, including to the Republic of Bulgaria.

Article 3. By placing an order, the Customer confirms that they have read, understood, and accepted these Terms and Conditions. These Terms shall apply without limiting any mandatory consumer rights provided under applicable law.

II. Orders & Products

Article 4. Orders are placed by selecting products, providing the necessary delivery information, and confirming the purchase. The Customer is responsible for ensuring that all information provided is accurate and complete.

Article 5. The sales contract shall be considered concluded once the Seller confirms acceptance of the order. An automated notification acknowledging receipt of an order does not necessarily constitute acceptance of that order.

Article 6. The Seller makes reasonable efforts to maintain accurate and up-to-date information regarding products, prices, and availability. In the event of a technical error, insufficient stock, or any other objective obstacle to fulfilling an order, the Customer shall be notified promptly. Refunds for unfulfilled orders shall be processed in accordance with applicable law.

Article 7. Product images are provided for illustrative purposes. Minor differences in colors may occur due to individual device settings. The Seller remains responsible for ensuring that products conform to their stated descriptions and specifications.

Article 8. Customers are advised to carefully review product descriptions and available size charts before making a purchase. The Seller shall not be responsible for incorrect size selections made by the Customer, without prejudice to the Customer’s statutory right of withdrawal or rights relating to non-conforming goods.

III. Prices & Payments

Article 9. All prices displayed on the website are stated in euros (EUR) and include applicable taxes. Shipping costs and any other charges that can be determined in advance are displayed before the final confirmation of the order.

Article 10. Payments shall be made using the payment methods available on the website. Additional bank fees and currency conversion charges may be applied by the relevant financial institutions in accordance with their terms and applicable law.

Article 11. The Seller reserves the right to modify prices and promotional offers at any time. Such changes shall not affect contracts already concluded, except where permitted by applicable law.

IV. Shipping & Delivery

Article 12. Shipping is available to countries and regions for which delivery services are offered. Shipping times and costs depend on the destination, selected shipping method, and other applicable conditions.

Article 13. Estimated delivery times may be affected by customs inspections, public holidays, transportation disruptions, and other circumstances beyond the Seller’s control. This shall not affect the Customer’s statutory rights in cases of delayed or failed delivery.

Article 14. The Customer is responsible for providing a complete and accurate delivery address. In cases of incorrect delivery information, unclaimed shipments, or refusal to accept delivery without a lawful reason, the Customer may be responsible for actual, reasonable, and justified additional costs associated with redelivery or return shipping, to the extent permitted by applicable law.

Article 15. The risk of accidental loss or damage to the goods shall pass to the Customer upon receipt of the goods or at another time expressly provided for under applicable law.

Article 16. In the event of damaged shipments or delivery discrepancies, the Customer should notify the Seller as soon as reasonably possible. Customers are encouraged to retain the shipping packaging and provide photographs to facilitate the investigation. These recommendations do not constitute conditions for exercising statutory consumer rights.

V. Customs Duties & International Shipping

Article 17. International shipments may be subject to additional customs duties, import taxes, and customs clearance fees. Unless expressly included in the total order price, such charges shall be the responsibility of the recipient. Customers are responsible for independently checking the applicable import regulations and requirements in their country of delivery before placing an order.

Article 18. The Seller does not determine or guarantee the amount of fees imposed by customs authorities or independent shipping carriers. The Seller shall not be liable for delays resulting from customs procedures beyond its control, except where such delays arise from the Seller’s failure to fulfill its own legal or contractual obligations.

VI. Withdrawal & Returns

Article 19. Consumers whose purchases are subject to European Union regulations governing distance contracts have the right to withdraw from their purchase within 14 days of receiving the goods, without providing any reason.

Article 20. To exercise the right of withdrawal, the Consumer must submit an unequivocal statement through the official contact channels or the electronic withdrawal function provided on the website. Returning a product without a withdrawal statement or failing to collect a shipment does not, in itself, constitute a valid exercise of the right of withdrawal.

Article 21. The Consumer must return the products within 14 days of notifying the Seller of their decision to withdraw. The direct shipping costs of returning the products shall be borne by the Consumer, unless otherwise required by applicable law. Returned products must be appropriately packaged to ensure safe transportation.

Article 22. The Consumer shall be responsible for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning, in accordance with applicable law.

Article 23. The right of withdrawal does not apply to products manufactured according to the Customer’s individual specifications or clearly personalized for the Customer, as well as other exceptions expressly provided for by law. Selecting a standard size, color, or pre-existing design from the product catalog does not, by itself, constitute individual personalization.

Article 24. For Customers outside the European Union, returns shall be governed by applicable mandatory local laws and the published return conditions, where applicable.

VII. Refunds

Article 25. Where the statutory right of withdrawal has been validly exercised, the Seller shall refund all amounts required by applicable law, including the value of the returned products and applicable initial standard delivery costs. Additional charges resulting from the Customer’s choice of a more expensive delivery method shall not be refunded where permitted by law.

Article 26. Refunds shall be processed within the legally prescribed period and using the same payment method employed for the original purchase, unless the Consumer expressly agrees to another legally permitted method. The Seller may withhold the refund until the returned products have been received or the Consumer provides evidence of having sent them back, whichever occurs first.

Article 27. For international payments, the Seller shall not be responsible for differences arising solely from currency exchange rate fluctuations or fees imposed by the Customer’s bank, without prejudice to the Seller’s obligation to refund all amounts required by applicable law.

VIII. Complaints & Warranties

Article 28. The Seller is responsible for ensuring that delivered products conform to the sales contract and applicable legal requirements. Consumers within the European Union benefit from a statutory guarantee of conformity of at least two years, unless applicable law provides more favorable protection.

Article 29. In the event of a defect or lack of conformity, the Customer may submit a complaint through the official contact channels. Statutory remedies may include repair, replacement, price reduction, or termination of the contract, subject to the conditions established by applicable law.

Article 30. The Seller shall not be responsible for damage caused exclusively by improper use, failure to follow product care instructions, or actions of the Customer that do not constitute a lack of conformity under applicable law.

IX. Personal Data & Intellectual Property

Article 31. Personal data shall be processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR), where applicable. Detailed information regarding personal data processing is provided in the published Privacy Policy.

Article 32. Text, images, graphic designs, and other protected materials displayed on the website are subject to intellectual property rights. Their use without the necessary authorization is prohibited, except where expressly permitted by law.

X. Liability & Other Provisions

Article 33. The Seller shall not be liable for failure to fulfill obligations caused by force majeure events or circumstances beyond its reasonable control, to the extent permitted by applicable law.

Article 34. The Seller reserves the right to refuse or suspend the fulfillment of an order where there are reasonable grounds to suspect fraud, unauthorized payment, or illegal activity, in accordance with applicable legal requirements.

Article 35. These Terms and Conditions may be amended or updated. Any changes shall not restrict rights already acquired under previously concluded contracts.

Article 36. Disputes shall, where possible, be resolved through mutual agreement. Customers may refer disputes to the competent consumer protection authorities or the appropriate court.

Article 37. Contracts shall be governed by the law determined in accordance with applicable international and national conflict-of-law rules. Consumers shall not be deprived of the protection afforded by mandatory provisions of the law of their country of habitual residence, where such provisions are applicable.

Article 38. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms and Conditions shall enter into force on the date of their publication on the website.
